Welcome to DarkHorse Fantasy Markets (the “Platform”). By accessing or using the Platform, you agree to comply with and be bound by these Terms and Conditions (the “Terms”). Please read these Terms carefully before using the Platform. If you do not agree to these Terms, you should not use the Platform. These Terms govern your participation on the Platform and your use of the DARK token.
DarkHorse Fantasy Markets is a decentralized sports futures leverage trading game where users use DARK tokens, a utility token, to speculate on the outcomes of sporting events. Users can participate in the game by staking DARK tokens to open positions on sports teams and potentially earn rewards based on the teams’ performance. No real money is used on the Platform, and all interactions are conducted via DARK tokens.
Not an Investment: DARK tokens are not an investment. The Platform does not guarantee or promise any expectation of profit. DARK tokens are utility tokens meant solely for interacting within the game, and participation should be considered for entertainment purposes only.
No Guarantees of Value: The value of DARK tokens may fluctuate based on market conditions and platform activity. The value of DARK tokens is not guaranteed, and there is no assurance that they will retain or increase in value.
Not Gambling: The Platform is designed as a game of skill and strategy where users can engage with sports futures markets using DARK tokens. The Platform does not offer or facilitate gambling of any kind. All participation is for entertainment purposes, and no real money is wagered or earned.
To use the Platform, you must:
Be at least 18 years of age or the age of majority in your jurisdiction.
Ensure that your use of the Platform is legal in your jurisdiction. It is your responsibility to comply with local laws regarding the use of the Platform and DARK tokens.
Utility Token: DARK tokens are used to interact with the Platform by opening positions on sports events and potentially earning rewards based on the performance of your positions. DARK tokens are purely for use within the Platform and cannot be considered currency or securities.
No Refunds: Once DARK tokens are used on the Platform, there are no refunds. All transactions are final, and the value of DARK tokens in the context of the game may fluctuate.
Fees: The Platform charges a transaction fee of 1% for platform maintenance and development. The fee structure may change in the future with appropriate notice.
Reward Pool: During the initial phase of the Platform, DARK tokens used in gameplay are held in a dedicated reward wallet to facilitate payouts and gameplay results. These tokens are temporarily allocated to the wallet when users open positions and are redistributed based on the outcome of sporting events. The Platform will not use or transfer the tokens held in this wallet for any purpose other than facilitating gameplay and payouts. The wallet address will be made publicly accessible for transparency.
Phase 1 (Beta): Once DARK tokens are used on the Platform, there are no refunds. All transactions are final, and the value of DARK tokens in the context of the game may fluctuate.
Phase 2: The Platform will transition to a decentralized mint-burn system, where tokens used to open positions are burned, and new tokens are minted based on position outcomes. Upon this transition, all remaining tokens in the reward wallet will be publicly burned, and the shift to a decentralized mechanism will be fully transparent.
All content and materials on the Platform, including the Platform’s name, logos, design, and technology, are owned by or licensed to DarkHorse Fantasy Markets and are protected by intellectual property laws. You are prohibited from using any of this content for commercial purposes without our written consent.
While the Platform does not store or manage users’ private keys, during gameplay, DARK tokens are held in a dedicated reward pool to process and facilitate gameplay outcomes. These tokens are stored for in game-related purposes only, such as staking positions, and are returned or redistributed based on game results. Users maintain control of their wallets outside of gameplay interactions.
No Private Key Storage: The Platform does not store users’ private keys or sensitive wallet information. Users maintain control of their wallets and DARK tokens outside of gameplay functions on the Platform.
Our Privacy Policy explains how we collect and use your information. By agreeing to these Terms, you also agree to our Privacy Policy. The only user information we collect is your wallet address used to sign up and participate in the game. We do not collect any personal information.
Blockchain, Crypto, Platform, and Gameplay Risks: The Platform operates on the Solana blockchain. You acknowledge that blockchain technology is subject to risks, including potential system failures, security vulnerabilities, and fluctuations in token value. Additionally, user positions data are stored in a secure database for gameplay purposes, which also carries the potential risks of system malfunctions, unauthorized access, or data breaches.
User Risks: You agree that your use of the Platform is at your own risk. The Platform is provided “as is” without any warranties of any kind. We are not liable for any losses related to your use of DARK tokens or the Platform.
We reserve the right to modify or update these Terms at any time. Any changes will be effective immediately upon posting on the Platform. Continued use of the Platform after such modifications means that you accept the updated Terms.
You are over 18 years of age or the higher legal age of majority as stipulated by the jurisdiction of your residence, and you are legally allowed to participate in the gameplay offered on the Platform.
You participate in the DarkHorse Fantasy Markets game strictly in your personal non-professional capacity, for recreational and entertainment purposes only.
You participate in the gameplay on your own behalf and not on behalf of any other person.
All information you provide to the Platform during your participation is true, complete, and correct, and you shall immediately notify the Platform of any changes to such information.
You are solely responsible for reporting and accounting for any taxes applicable to you under relevant laws for any rewards or earnings you receive from gameplay on the Platform.
You understand that by participating in the game, you are using DARK tokens, which are utility tokens designed for gameplay purposes. You may gain or lose DARK tokens based on the outcome of your gameplay, and the value of DARK tokens may fluctuate.
ou shall not engage in any fraudulent, collusive, manipulative, or unlawful activity in relation to your or third parties’ participation in the game. Any such behavior will result in the immediate suspension or termination of your account, and DarkHorse Fantasy Markets reserves the right to void any gameplay associated with such behavior.
You understand that DARK tokens are not a legal currency or tender and are used solely for interaction within the Platform as a utility token. DARK tokens hold no intrinsic value outside of the Platform.
You understand that the value of DARK tokens can change significantly depending on market conditions and that you participate at your own risk.
Gameplay on the Platform should be conducted in a courteous and respectful manner, and you should refrain from using offensive or obscene language in any communication with other players.
In the event that a transaction or reward payout is made in error, DarkHorse Fantasy Markets reserves the right to correct the error by voiding the transaction or readjusting the payout.
If you become aware of any errors or technical issues with the Platform, you agree to immediately notify DarkHorse Fantasy Markets and refrain from exploiting such errors. Any failure to notify the Platform may result in the suspension of your account and the revocation of any rewards obtained through such exploitation.
In the event that a game or position is interrupted due to a technical issue, DarkHorse Fantasy Markets will take reasonable steps to restore the affected transaction and refund or credit any associated DARK tokens as necessary.
You may not participate in gameplay with an amount of DARK tokens that exceeds the balance of your account.
The Platform reserves the right to Freeze tokens belonging to wallets that were gained in hacking attempts or manipulation or fraudulent behavior. Any users found to be manipulating the system or engaging in unlawful behavior will face an immediate freeze.
The Platform reserves the right to declare a transaction void, in part or in full, if any of the following circumstances are deemed to have occurred: Transactions have been placed during periods of technical issues on the Platform that would not have been accepted otherwise.
